Entrapment is a crucial legal defense used in cannabis-related prosecutions. It refers to a situation where law enforcement officers induce or persuade an individual to commit a crime—in this case, a cannabis-related offense—that they would not have otherwise committed. The key element is the government's active involvement in creating the criminal act, rather than simply investigating existing criminal activity.

Successfully arguing entrapment typically requires demonstrating two key elements:

  • Predisposition: The defendant must show they were not predisposed to commit the crime. This means demonstrating a lack of prior criminal involvement in cannabis offenses, or a reluctance to participate in the illegal activity until pressured by law enforcement. Evidence of a defendant's prior lawful behavior and rejection of initial suggestions to engage in illegal activity are commonly used to establish a lack of predisposition.
  • Government Inducement: The defendant must prove that law enforcement agents used improper tactics to induce the crime. This might include persistent solicitation, threats, coercion, or promises of leniency or reward. Simple investigation and undercover operations are generally not considered inducement, as law enforcement is expected to investigate potential crimes. The line between investigation and inducement is often the subject of legal debate.

Consequences of a Successful Entrapment Defense

If a defendant successfully argues entrapment, the charges against them will be dismissed. The court will find that the government's actions were so egregious that prosecuting the case would be fundamentally unfair.

The legal landscape surrounding cannabis varies significantly between jurisdictions, impacting the likelihood of a successful entrapment defense.
